Módems USB de MÁSmovil: Bases del sorteo

1- ORGANIZADOR
El presente sorteo está organizado por Más Móvil Telecom 3.0. S.A. (en lo sucesivo "MÁSmovil"), con domicilio a estos efectos en San Sebastián de los Reyes (Madrid), calle Fuerteventura 4, Oficina 1/3, y CIF A84633643 a través del sitio web http://es.engadget.com.
2- OBJETIVO Y ÁMBITO
El objetivo es organizar un sorteo de 5 módem USB libre valorado en 69 euros (IVA no incluido) junto con 5 tarjetas SIM con un saldo de 50 euros cada una entre los usuarios del sitio web de Engadget que realicen un comentario al post de la página http://es.engadget.com dedicado a MÁSmovil. La participación en el sorteo será gratuita.
Podrán participar en el sorteo únicamente mayores de dieciocho años residentes en España. No podrán participar los empleados (personas naturales o jurídicas) de MÁSmovil ni de Engadget ni sus familiares directos.
3- CELEBRACIÓN DEL SORTEO
La promoción comenzará el 18 de abril de 2011 a las 12 h. y finalizará el 25 de abril de 2011 a las 12 h. El sorteo se realizará el día 26 de abril de 2011 y se publicarán en la página web de Engadget el 27 de abril.
Los ganadores serán seleccionados por procedimiento totalmente aleatorio y 3 suplentes para el caso de identificación incompleta o incorrecta de alguno de los ganadores o incumplimiento de cualquiera de las presentes bases, así como la renuncia o imposibilidad de localización del ganador en el plazo máximo de siete (7) días contados desde la fecha de celebración del sorteo.
MÁSmovil se reserva el derecho a modificar libremente la fecha de este sorteo a su conveniencia, siempre que esta variación no produzca perjuicio alguno a los participantes en la promoción, considerando que, para el caso de variación de la fecha inicial del sorteo, MÁSmovil se compromete a hacer prevalecer, siempre que las circunstancias lo posibiliten, entre los criterios de decisión de la nueva fecha, el de proximidad temporal con la fecha inicial del sorteo, sin que en ningún caso la fecha de celebración del nuevo sorteo se demore en más de sesenta días a la prevista inicialmente.
4- NOTIFICACIÓN
La notificación al ganador del sorteo se realizará personalmente mediante e-mail y/o llamada telefónica a la dirección y/o número de teléfono facilitados para tal fin a Engadget. Será responsabilidad del ganador mantener la vía de comunicación empleada en perfectas condiciones de uso; especialmente, deberá mantener un espacio libre suficiente disponible en la cuenta de correo electrónico para asegurar la correcta recepción de la comunicación por parte de MÁSmovil.
Una vez efectuada la comunicación válida al ganador, éste dispondrá de un plazo improrrogable de siete (7) días naturales para confirmar su aceptación o eventual renuncia, que deberá realizarse por cualquier medio fehaciente que permita tener constancia de su recepción.
Para el caso de que los datos personales del ganador no fueran válidos, o no haya sido posible contactar con él en el citado plazo, o si hubiera manifestado su voluntad clara e inequívoca de renunciar al premio, éste pasará al suplente. En el caso de no cumplir el suplente los criterios anteriormente mencionados, el premio quedará desierto.
5- ENTREGA DE PREMIOS
Engadget será la responsable de recabar los datos personales de los ganadores y de hacérselos llegar a MÁSmovil con la finalidad de realizar la entrega de premios.
Los ganadores deberán facilitar a Engadget su nombre, dirección, teléfono y correo electrñonico.
Los ganadores deberán acreditar su identidad con la remisión a Engadget de fotocopia del DNI, pasaporte o cualquier otro documento oficial vigente.
MÁSmovil hará entrega del premio al ganador mediante envío postal.
En ningún caso el premio obtenido podrá ser canjeado por otro regalo o por dinero en efectivo.
6- CONDICIONES
MÁSmovil no se hace responsable de los errores, interrupciones, defectos, tardanzas de operaciones o transmisiones, robo, destrucción, acceso no autorizado o alteraciones de los materiales de inscripciones del sorteo, o de cualquier mal funcionamiento, mala transmisión o error en recibir cualquier información de la misma.
Tampoco se hace responsable de los errores técnicos de tráfico, congestión en ninguna conexión a Internet, etc.
También se reserva el derecho de descalificar en la participación del sorteo a aquellos que:
MÁSmovil se reserva el derecho a dar de baja y expulsar automáticamente a cualquier participante del que estime que realiza un mal uso o abusa de la promoción, con la correspondiente cancelación de su participación. Se entiende como mal uso el incumplimiento de cualquier condición de participación incluida en estas bases.
Ante cualquiera de estas actuaciones, MÁSmovil se reserva, asimismo, el derecho de emprender acciones legales.
MÁSmovil no será responsable por los posibles daños y perjuicios que pudieran sufrir el ganador del sorteo durante el disfrute del premio.

MÁSmovil cumple en el tratamiento de los datos personales de los ganadores, los cuales serán facilitados por Engadget, con la legislación vigente en España y en la Unión Europea, en particular, con la Ley Orgánica 15/1999, de Protección de Datos de Carácter Personal y su legislación de desarrollo. El ganador que acepte el premio consiente expresamente en que MÁSmovil y Engadget utilicen, publiquen y reproduzcan en todo el mundo y sin limitación su nombre, apellidos, ciudad de residencia y una fotografía obtenida en el momento de la entrega del premio para cualquier publicidad o comunicación relacionada con la presente promoción que podrá ser publicada tanto en la web de MÁSmovil como en la de Engadget y en distintos medios de comunicación, sin que el ganador tenga derecho a contraprestación alguna por este concepto.
9- RESERVA
MÁSmovil se reserva el derecho a modificar en cualquier momento las condiciones de la presente promoción, incluso su posible anulación antes del plazo prefijado, siempre que concurra causa justa para ello, comprometiéndose a comunicar las nuevas bases, condiciones de la promoción o su anulación definitiva.

The goal is to organize a lot of 5 free USB modem valued at 69 euros (excluding VAT) together with 5 SIM cards with a balance of 50 euros each between web site users to conduct Engadget post a comment to this page http://es.engadget.com dedicated to MÁSmovil. Participation in the draw will be free.
May participate in the lottery only over eighteen years living in Spain. Employees may not participate (natural or legal) Engadget MÁSmovil or their immediate families.
3 - CELEBRATION OF THE DRAWING
The promotion will begin on April 18, 2011 at 12 h. and end on April 25, 2011 at 12 h. The draw will take place on April 26, 2011 and posted on the Engadget website on 27 April.
The winners will be selected by a totally random process and 3 alternates in the event of incomplete or incorrect identification of some of the winners or breach of any of these rules and the resignation or inability to location of winner within seven ( 7) days from the date of the draw.
MÁSmovil reserves the right to freely change the date of this sweepstakes at their convenience, provided that this variation does not cause any harm to the participants in the promotion, whereas in the case of variation of the initial date of the draw, agrees MÁSmovil to bring about, as long as circumstances allow, among the decision criteria of the new date, the temporal proximity to the initial date of the draw, but in any case the date of the new draw be delayed more than sixty days originally anticipated.
4 - NOTIFICATION
The notification to the winner of the draw will be made personally by e-mail or phone call to the address and / or phone number provided for that purpose to Engadget. It is the responsibility of the winner keep the communication channel used in perfect working order, especially, must keep enough free space available on the email account to ensure proper receipt of communication from MÁSmovil.
